Amendments to O.C.G.A. § 50-36-1 become effective January 1, 2012.  After December 31, 2011, Georgia law will require all applicants for licensure, and all those applying for renewal of an existing license, to submit secure and verifiable documentation with their application.  Please consider filing your renewal application on or before December 31, 2011 as this will expedite your renewal.  A list of the approved Secure and Verifiable Documents may be found on this page or on the Attorney General’s website. The 15-member Georgia State Board of Registration of Used Motor Vehicle Dealers and Used Motor Vehicle Parts Dealers is composed of two divisions, a Used Motor Vehicle Division and a Used Motor Vehicle Parts Division.Nine members are appointed by the Governor to serve with the Used Motor Vehicle Division and 6 members are appointed to serve with the Used Motor Vehicle Parts Division.

Each division determines the qualifications of licensure as set forth by the law.It is unlawful for any person to operate as a used motor vehicle dealer or used motor vehicle parts dealer without first registering and obtaining a license.If a licensee is found to have violated the law or Board rules, the Division has the power to impose fines and penalty fees and to revoke or suspend a license for a specified time. Division meetings are held at the Secretary of State’s office in Macon and are open to the public.Persons wishing to bring matters for the Division’s consideration should submit written notification or request to the office.

The Used Motor Vehicle Division issues a “used motor vehicle dealers” license which includes motor vehicle brokers, independent motor vehicle leasing agencies which sell or offer to sell used motor vehicles, used motor vehicle auction companies and pawnbrokers who sell motor vehicles to the public.

The Used Motor Vehicle Parts Division issues a “used parts” license, which includes used parts dealers, rebuilders, and salvage dealers.

Issued Cease and Desist Orders for Unlicensed Professionals

Effective January 1, 2007, the amount of the required surety bond for used motor vehicle dealers will increase to $35,000. All new applicants submitting applications for licensure as used motor vehicle dealers must purchase and maintain a surety bond in the amount of $35,000. If you are currently licensed as a used motor vehicle dealer with an active surety bond, you will not be required to purchase the updated bond until your licensure situation changes, or until the renewal date of your license and bond, which is March 31, 2008.
