Update from the Director of the Professional Licensing Boards:
PLB is working diligently to become one of the most technologically advanced licensing agencies in the country.  Throughout this year we have continued to review our business processes and implement technology to increase our performance levels and customer service for our licensees and the general public.

This quarter we have continued to make improvements to the licensure process by implementing the first online applications.  We currently have online applications available for 23 license types with plans to add more throughout the remainder of the year.  There are many advantages to online applications, including ensured completion, decreased paper use, a higher degree of accuracy, and a faster application process. You can visit our website at www.sos.ga.gov/plb to see a complete list of online applications.

Finally, during the third quarter we made significant progress in the outsourcing of the PLB Examination section.  Outsourcing the exam function of PLB allows us to offer more testing locations for some license types, more testing opportunities and overall budget savings for the State of Georgia.  More information will be available in the coming weeks as all outsourcing contracts are finalized.

The Georgia State Board of Barbers consists of six members: five barbers and one consumer member. Typically, the Board meets bi-monthly for regular business and holds additional meetings for citation hearings. Board meetings and citation hearings are open to the public with the exception of executive session in which confidential matters such as complaints, disciplinary items, and applications are discussed.

The Board is responsible for reviewing applications, administering examinations, licensing qualified applicants and regulating the professional practice of licensees throughout the state. Applicants for licensure must meet the required educational and training requirements before they are allowed to sit for the practical and written examination. In addition, shops are inspected and complaints are investigated to determine whether or not disciplinary action by the Board is warranted.

Actions Taken by the Georgia State Board of Barbers

August 10:
The Board voted to post amendments to the following rules:
• 70-2-.10, Cross-Over Licensing: Adds requirement that the applicant submit evidence of passing the written and practical examination.
• 70-3-.02, Barber School Curriculum. Amended: Amends curriculum for barber schools.
• 70-3-.04, Cross-Over Training Curriculum Requirements for Master Cosmetologist to become a Barber. Amended: Clarifies training requirements for a master cosmetologist to become a barber.
• 70-6-.01, Applicants for Master Barber or Barber Instructor’s License by Examination: Amends rule to define new procedures for applying by examination and explains how emergency situations are handled.
• 70-6-.02, Applicants for Teacher’s License. Reserved: Language in this rule is move to Rule 70-6-.01. This number will be reserved for later use.
• 70-6-.03, Examination and License Fees. Amended: This amendment explains the board agent’s responsibilities in administering examinations; how reasonable accommodations will be made with regard to ADA issues; and examinations are given in English and the passing score for each section will be a minimum scale score of 70 percent.

The Board voted to decrease the application fees for barber and instructor licensure from $50 to $30.

Beginning October 1, 2009, the Master Barber and Barber Instructors examinations will be administered only by D.L. Roope Administrations, Inc. 

The Georgia State Board of Barbers is no longer accepting any examination applications for Master Barbers and Barber Instructors. Candidates must apply for examination with D. L. Roope Administrations, Inc.

The National Institute of Cosmetology (NIC) has prepared a school overview DVD that has some helpful information concerning preparing students for examination.  The Overview contains an introduction into NIC testing and procedures, as well as complete presentations on Cosmetology, Nail Tech/Manicuring, Esthetics, and Barber examinations.  If you would like to purchase the DVD, please visit their website to obtain an order form.  Their website address is http://www.nictesting.org/testing.htm.

After obtaining a passing score on both the written and practical portion of the examination, a candidate must submit an application for licensure to the Georgia State Board of Barbers with the appropriate fee.  You may submit a master barber or barber instructor application online at https://secure.sos.state.ga.us/mylicense/ or download a paper application from the Board’s website at www.sos.ga.gov/plb/barber. Please be reminded that passing the written and practical exam does not guarantee licensure.  All criminal convictions and any board sanctions must be reviewed by the Board as a consideration for licensure.

License Renewals:

Licenses expire as follows:

Master Barbers – December 31 of even numbered years
Barber Instructors – June 30 of odd numbered years
Barber Schools – June 30 of odd numbered years
Barber Shops – June 30 of odd numbered years

It is illegal to practice barbering with an expired license.

How do I renew my license? 

Once the renewal period has been opened by the Professional Licensing Boards Division, you may renew your license via our website with a credit card. Click on the “License Renewal” icon and follow the instructions. You will be asked a series of questions including whether or not you have been convicted or received a board sanction since the last renewal, and whether or not you are a U.S. citizen. Read the questions carefully so that you do not answer a question incorrectly by mistake. Renewing your license via the website is the fastest way to renew your license.

The Professional Licensing Boards do not mail paper renewals unless requested. A paper renewal form may be requested by the licensee by calling the Board office at (478) 207-2440, or submitting a written request. Licensees may also call our automated system at (404) 463-1100 and request a paper renewal form using their personal identification number included in their renewal notice.

Disciplinary Issues:

The Board addresses these issues on a case by case basis, and the Board takes these matters very seriously and applies sanctions to those who violate the Georgia Barbering Practice Act, Board rules, and policies. It is important that licensees review all laws, rules and policies that affect their profession. These may be found on the Board’s website at www.sos.ga.gov/plb/barber.

All public disciplinary actions will be reflected in the Board minutes which may be found on the Georgia State Board of Barbers website.

Grounds for denial, suspension, revocation of a license, or other disciplinary actions may be found at O.C.G.A. § 43-7-23 and at O.C.G.A. § 43-1-19. State laws and Board rules may be found on the Georgia State Board of Barbers website.

Georgia State Board of Barbers Complaints Process Information:

The Georgia General Assembly created the Georgia State Board of Barbers to regulate the licensing and practice of cosmetology. The responsibility of administering the laws in O.C.G.A. § 43-7 is given to the Board, whose members are appointed by the Governor. This Board determines if applicants meet licensure requirements, promulgates rules, and considers complaints against licensees and allegations of unlicensed practice. The process for disposing of complaints is as follows:

Complaint Form:

Complaints must be reported and received by the Board in writing. Written complaints may be submitted to the Board office or on-line at http://sos.georgia.gov/myverification/submitcomplaint.aspx. Documents received in connection with a complaint will not be returned. The complaint must contain sufficient factual evidence indicating a clear violation of Georgia law or Board rules.

Inspections and Investigations:

The Board gives serious consideration to all complaints. Further investigative action may be taken. Should you file a complaint, you may be contacted by a Board inspector or investigator for additional information. Investigative files are considered confidential for any purpose other than a hearing before the Board. However, the Board is authorized to release such records to another enforcement agency or lawful licensing authority.

Typically, when complaints are received they are forwarded to an inspector for an inspection of the facility. Inspectors also conduct random inspections of salons and shops. Upon inspection, if a rule violation is found, a citation is issued to the salon/shop owner. The owner may pay the citation or may request a citation hearing. Unpaid fines are scheduled by the Board for citation hearings.

Citation Hearings:

At citation hearings, a licensee who has received a citation may choose to bring an attorney to represent him or her, may question witnesses, and have an opportunity to dispute their cases before the Board. After hearing from the inspector and the licensee, the Board has to determine if an apparent violation of the licensing law or Board rules exists. The Board may then choose to uphold the fine, reduce the fine, or dismiss the citation. The Board may also ask for another inspection of the facility. If a citation is upheld or reduced by the Board and still has not been paid, the Board may refer the case to the Office of the Attorney General to initiate further disciplinary action.

Notification Process:

While the investigation is ongoing, the Board is unable to discuss the status of a complaint with anyone, including the complainant. When the Board has completed the case, the complainant will be notified in writing of the Board’s actions. All public disciplinary actions will be reflected in the Board minutes which may be found on the Board’s website.
